Bookings are accepted by Spirit of Tuscany on the following conditions:

1: Policies and procedures are subject to change without notice.

2: In the event your chosen villa is available at the time you require, we can ‘reserve’ it for a period of two days while you decide. If you do not confirm your reservation by the end of this time, your option on the property will automatically expire and it will be made available to the public once more.

3: When you confirm your reservation (by phone, fax or email) you will have a period of 5 days (including weekends and public holidays) for us to receive your deposit. Receipt of this deposit will guarantee your booking and commit you to paying the balance of the rent to the villa owner on the arrival date even if occupancy is subsequently not taken up for whatever reason. If we do not receive your agreed deposit by the end of this time, your option on the property will expire and it will be made available to the public once more.

‘Reservation’ = 2-day option to ‘hold’ your choice from other potential customers.
‘Booking’ = confirmation of rental and commitment to pay villa owner remaining rental amount.

4: The deposit will be a sum approximately equivalent to 1/3 of the advertised price of the villa for the term required although this ratio varies with some villas and apartments. Spirit of Tuscany will advise you of the exact amount upon booking. As villa and apartment prices are posted in Euros, Spirit of Tuscany will also advise you of the sterling conversion for the deposit using the daily rates advised by Reuters (www.reuters.co.uk). This sum is non-refundable.

5: Payment of deposit to be made in sterling by cheque, written out to ‘Spirit of Tuscany’ and posted to:

6: Monies payable upon arrival at villa/apartment:

All prices will be confirmed by Spirit of Tuscany and accepted by the customer at the time of booking regardless of subsequent exchange rate fluctuations.

a: The remaining amount after the deposit is subtracted is payable in Euros to the villa owner in Tuscany. We will advise you of the exact amount payable in Euros before your departure. Villa owners expect payment when they meet guests upon arrival. (This payment is subject to 6f & 6g below.)

b: The Refudable Breakage Deposit: The Refundable Breakage Deposit  (as posted on the Website for each villa/apartment) is payable to the villa owner in cash or Euro cheque upon arrival and will be refunded upon departure providing there is no damage, breakages or missing items. Any damage, breakages and missing items will be evaluated by the villa owner and deducted from the security deposit and the outstanding amount refunded upon departure.

c: Use of bed linen and bathroom towels - €10 extra per person upon arrival and €10 per person per subsequent change during the occupancy unless included as stated on the website.

d: Cleaning: rate posted on the website for each villa/apartment per stay.

e: Electricity and gas when at a fixed weekly rate as posted on the website (otherwise paid at departure based on ‘meter reading’ at end of stay).

f: In the event of occupancy not being taken up due to reasons that are deemed by Spirit of Tuscany to be beyond the control the customer upon demonstration of proof of such reasons (e.g. serious illness, major accident, death, fire, flood or other adverse act that directly impacts on the circumstances of the customer), the outstanding amount (specified in 6a above) that would normally be payable to the villa owner upon arrival is exempt if the arrival date is more than 60 days after the adverse event occurs. (In such eventualities, the initial deposit paid is nevertheless still non-refundable and the customer shall have no further claim against the owners or Spirit of Tuscany.)

g: If the serious illness, major accident, death, fire, flood or other adverse act occurs within the 60 day period before occupancy (ie: 59 days prior to occupation or less), the villa owner will be deemed to be unable to re-let the premises booked by the said customer and full payment of the outstanding rental amount (as specified in 6a above) must be made to Spirit of Tuscany who will reimburse the villa owner. (In such eventualities, the initial deposit paid is also still non-refundable and the customer shall have no further claim against the owners or Spirit of Tuscany.)

7: Should a customer wish to make any change to a confirmed booking, Spirit of Tuscany will do its best to accommodate the changes subject to time constraints and availability or any other factor deemed to prohibit the effective modifications to the booking requirements. Any such change is subject to payment of an administration fee of £20 to Spirit of Tuscany and any associated costs of the change imposed by the owner of the villa being cancelled. NB: accommodation changes made within 60 days of tenants arrival will be treated as a cancellation and new booking, and the customer is therefore liable to a cancellation fee equivalent to 100% of the villa rental.

8: Customers are requested to arrive no earlier than 1600hrs (4pm local time) on the day of arrival so the villa/apartment can be cleaned after the out-going guests.

9: As the villa owners will be expecting you at 1600hrs (4pm local time) or shortly thereafter on the day of arrival, you are requested to contact Spirit of Tuscany (00 44 7756 714 766 from Italy - 07756 714 766 from your UK cell phone in Italy) if you think you are going to be delayed beyond 1800hrs (6pm local time) so that we can inform them.

10: Customers are requested to vacate the accommodation no later than 1000hrs (10am local time) on the day of departure so the villa/apartment can be cleaned for the in-coming guests.

11: The customer will not cause any annoyance or nuisance to occupants of adjoining premises.

12: Any items of personal property left by the customer can be forwarded on receipt of a minimum handling fee of £5 plus VAT. Any unclaimed articles will be disposed of after 28 days.

13: Neither the villa owner nor Spirit of Tuscany shall be held responsible for any accident, loss or damage, which may be sustained by customers, members of their party, or visitors, however caused. Swimming pools, where available, are used entirely at customers’ own risk and no liability whatsoever is accepted by the villa owner or Spirit of Tuscany.

14: For health and safety reasons, accommodation is let for the specified number of guests only and excess of these numbers cannot be accepted.

15: Domestic pets are permitted in many properties and Spirit of Tuscany must be advised before booking if customers wish to take advantage of this option. Properties which specify ‘No Pets’ on the website www.spirit-of-tuscany.co.uk may not be a guarantee that pets have never occupied the property.

16: Every effort is made to ensure the standards described for each property and that all the items of equipment specified and supplied by the villa owners are in good working order. However, no guarantee is given or liability accepted if these details vary or if any breakdown occurs during occupancy. Repairs are always effected as soon as possible, although inevitably delays do occur.

19: Any contract shall be governed by English law and interpretation, and court hearings will be restricted to the area in which the property is situated.

18: All details on this website (www.spirit-of-tuscany.co.uk) are given in good faith and are believed to be correct. However neither Spirit of Tuscany nor the villa owners accept responsibility for the accuracy or any claims or information supplied herewith.

19: All information, prices and claims made by linked websites posted on the 'Useful Links' page of www.spirit-of-tuscany.co.uk are made by the owners of the respective websites and are posted as useful information and services only and as such are in no way the responsibility in law or otherwise of Spirit of Tuscany or its employees.

20: All bookings are accepted at the discretion of Spirit of Tuscany and the villa owners.

21: Spirit of Tuscany acts as agents for the villa owners and accepts no liability for personal injury, loss or misadventure whatsoever in any situation involving occupancy of the villas and apartments or during the course of the customers' holiday in Tuscany other than a duty to offer information and bookings for villas and apartments as posted at www.spirit-of-tuscany.co.uk. 

TERMS:
'Villa owner' and 'owner' is deemed to mean the legal and rightful owner of the land, property and accommodation in Tuscany and Umbria that is offered on the website www.spirit-of-tuscany.co.uk.
'Villas and apartments' is deemed to mean the accommodation offered on the website www.spirit-of-tuscany.co.uk.
'Customers' is deemed to mean those persons who have paid a deposit to Spirit of Tuscany and the subsequent villa-owner's fee upon arrival in Tuscany and who occupy said villa or apartment for a contracted period.
‘Reservation’ or 'to reserve' a villa or apartment is deemed to be the option to ‘hold’ a customer's choice exclusive from other potential customers for a period of two days only, after which time the said villa or apartment is made available to the general public via the medium of the website www.spirit-of-tuscany.co.uk or any other medium considered suitable by the owners of the Spirit of Tuscany service.
‘Booking’ or 'to book' a villa or apartment is deemed to be confirmation of rental and a commitment to pay the deposit to Spirit of Tuscany within 10 days (see conditions 3, 4 and 5 above) and the remaining amount to the villa owner upon arrival at the said villa or apartment (see condition 6a above). Non-receipt of the customer's deposit within the 10-day period will result in the customer's option on the property expiring and the accommodation made available to the public once more.
'Prices' is deemed to mean any monies quoted for any aspect of the Spirit of Tuscany service on the website www.spirit-of-tuscany.co.uk in any recognised currency, or either verbally or in any other medium, electronic or otherwise, by Spirit of Tuscany employees and to refer to deposits, security amounts, heating costs, villa owners' fees etc.
'The website', refers to the Spirit of Tuscany website at www.spirit-of-tuscany.co.uk or www.spirit-of-tuscany.com.
